This Acceptable Use Policy (“AUP”) governs the use of all Rubic Management LLC (“Rubic,” “we,” “us,” or “our”) software, platforms, automations, messaging tools, AI features, and related services (the “Services”).
By using the Services, you agree to comply with this AUP in full.
1. Scope of Responsibility
Rubic is responsible for maintaining the security, availability, and integrity of its platform infrastructure, as outlined in its Security and Risk documentation.
You are solely responsible for:
The data you upload
The content you send
The contacts you message
The legality of your campaigns
Your compliance with applicable laws and regulations
Rubic provides tools only, not legal or compliance validation.
2. Prohibited Data Storage
You may not store, transmit, or process restricted or sensitive data through the Services, including but not limited to:
Credit card numbers or payment credentials
Bank account or financial account data
Social Security numbers or government-issued IDs
Health or medical information unless you have purchased Rubic’s HIPAA Compliance add-on and executed a Business Associate Agreement (BAA)
Violation of this section may result in immediate suspension or termination.
3. Messaging & Outreach Compliance
You must ensure all messaging activities comply with:
TCPA
CAN-SPAM
A2P 10DLC requirements
Carrier policies and industry standards
While Rubic supports compliance mechanisms (e.g., opt-outs, campaign registration), use of the platform alone does not constitute compliance.
You are solely responsible for:
Obtaining and retaining valid consent
Maintaining proof of opt-in
Honoring opt-outs immediately
4. Prohibited Uses
You may not use the Services to engage in:
Fraud, scams, or deceptive practices
Harassment, abuse, or coercion
Spam or unsolicited messaging
Income claims or guaranteed results
Illegal or regulated activities without authorization
Attempts to bypass platform safeguards
5. Monitoring & Enforcement
Rubic employs logging, monitoring, and anomaly detection systems to protect platform integrity and availability.
Rubic may investigate activity when required by law, carriers, or security concerns, but does not assume responsibility for user compliance.
6. Suspension & Termination
Rubic may suspend or terminate access without notice if it determines, in its sole discretion, that:
This AUP has been violated
Platform integrity is at risk
Regulatory, carrier, or legal exposure exists
Suspension or termination does not entitle you to a refund.
7. No Liability for User Actions
Rubic is not liable for:
User-generated content
Messaging activity
Compliance failures
Regulatory fines or penalties arising from your use of the Services
8. Indemnification
You agree to indemnify and hold harmless Rubic Management LLC from any claims, damages, losses, penalties, or expenses arising from:
Your use of the Services
Your violation of this AUP
Your failure to comply with applicable laws
9. Policy Updates
Rubic may update this AUP at any time. Continued use of the Services constitutes acceptance of the updated policy.
