Rubic Management LLC – Compliance & User Responsibility Policy

This Compliance & User Responsibility Policy (“Policy”) governs the responsibilities of customers, users, partners, and account holders (“User,” “Client,” “you”) who access or use the services, software, automations, messaging tools, AI features, and infrastructure provided by Rubic Management LLC (“Rubic,” “we,” “us,” or “our”).

By using Rubic’s services, you agree to this Policy in full.

1. Role of Rubic

Rubic is a technology service provider.

Rubic provides:

Software tools

Automation infrastructure

Messaging and workflow capabilities

Data processing and storage services

Rubic does not:

Provide legal advice

Provide compliance certification

Approve or validate user campaigns

Assume responsibility for user data sources or messaging consent

Use of Rubic’s platform does not constitute legal or regulatory compliance.

2. User Responsibility for Legal & Regulatory Compliance

You are solely responsible for ensuring that your use of Rubic’s services complies with all applicable laws, regulations, and industry requirements, including but not limited to:

Telephone Consumer Protection Act (TCPA)

CAN-SPAM Act

A2P 10DLC messaging requirements

General Data Protection Regulation (GDPR)

California Consumer Privacy Act (CCPA)

Health Insurance Portability and Accountability Act (HIPAA)


(HIPAA compliance applies only if you purchase Rubic’s HIPAA Compliance add-on and execute a Business Associate Agreement (BAA)

This responsibility applies regardless of whether compliance tools or features are made available within the platform.

3. Data Controller vs. Service Provider

For purposes of privacy and data protection laws:

You are the data controller (or equivalent legal role)

Rubic acts as a service provider / data processor

You determine:

What data is collected

How it is used

Who is contacted

The legal basis for processing and messaging

Rubic processes data only as instructed through your use of the platform.

4. Consent & Data Source Responsibility

You represent and warrant that:

All contact data was lawfully obtained

You have valid, documented consent where required

You maintain proof of opt-in or authorization

You honor opt-out and unsubscribe requests immediately

You comply with all disclosure and identification requirements

Rubic may request documentation at any time, including:

Proof of consent

Campaign registration records

Data source explanations

Written compliance attestations

Failure to provide requested documentation may result in suspension or termination.

5. Messaging, Outreach & Campaign Compliance

You are solely responsible for ensuring that all messaging campaigns:

Are lawful

Are truthful and non-deceptive

Comply with carrier and regulatory requirements

Do not violate Rubic’s AUP or Non-Income Guarantee Policy

While Rubic may provide features that support compliance (e.g., opt-outs, throttling, campaign registration), these features do not guarantee compliance and do not shift responsibility to Rubic.

6. Third-Party Data & Integrations

You are fully responsible for compliance issues arising from:

Imported contact lists

Purchased or third-party data

Integrations, APIs, webhooks, or external tools

Lead sources outside of Rubic

Rubic is not responsible for validating third-party data or integrations.

7. Monitoring, Review & Enforcement

Rubic may monitor usage patterns, logs, and system activity to:

Protect platform integrity

Respond to carrier or regulatory inquiries

Investigate suspected misuse or non-compliance

If Rubic suspects non-compliance, it may:

Immediately suspend access without prior notice

Temporarily restrict services pending review

Permanently terminate accounts

Rubic is not obligated to conduct investigations before enforcement.

8. Consequences of Non-Compliance

Violations of this Policy may result in:

Immediate suspension or termination

Loss of access to services and data

Forfeiture of any refunds, credits, or remaining services

Indemnification obligations

Cooperation with carriers, regulators, or law enforcement where required by law

Enforcement actions are taken at Rubic’s sole discretion.

9. Indemnification

You agree to indemnify, defend, and hold harmless Rubic Management LLC, its officers, members, employees, and agents from any claims, fines, penalties, damages, losses, or expenses arising from:

Your use of the platform

Your data collection or messaging practices

Your failure to comply with applicable laws or regulations

10. No Limitation on Other Policies

This Policy operates in conjunction with, and does not limit, Rubic’s:
